Welcome to DiepeRust

These Terms of Service ("Terms") govern your use of the DiepeRust mobile application and related services (collectively, the "Service"). By using DiepeRust, you agree to these Terms. If you don't agree, please don't use our Service.

1. Acceptance of Terms

By downloading, installing, or using DiepeRust, you agree to be bound by these Terms. If you're using the Service on behalf of an organization, you're agreeing to these Terms for that organization and promising that you have the authority to do so.

2. Use of the Service

What DiepeRust Is

DiepeRust is a meditation and breathing exercise app designed to help you find calm in moments of crisis, stress, or overwhelm. It provides:

  • Guided 2-minute box breathing sessions
  • 1 free session per day for non-premium users
  • Unlimited sessions for premium subscribers
  • Real-time statistics showing you're not alone

What DiepeRust Is Not

Important: DiepeRust is not a substitute for professional medical or mental health care. If you're experiencing a mental health crisis, please:

  • Contact emergency services (911 in the US, 112 in Europe)
  • Call a crisis helpline (988 Suicide & Crisis Lifeline in the US)
  • Reach out to a licensed mental health professional

3. Free and Premium Tiers

Free Tier

Free users can complete 1 breathing session per calendar day. This limit resets at midnight in your local timezone.

Premium Subscription

Premium subscribers get:

  • Unlimited breathing sessions
  • Access to all features and future updates

Subscriptions are billed monthly through the App Store (iOS) or Google Play Store (Android). You can cancel at any time through your app store account settings.

4. Payments and Refunds

All payments are processed by Apple (for iOS) or Google (for Android):

  • We don't have access to your payment information
  • Refund requests must be made through the respective app store
  • Subscriptions automatically renew unless canceled
  • You can cancel your subscription at any time, but no partial refunds are provided

5. Acceptable Use

You agree to use DiepeRust only for its intended purpose. You may not:

  • Reverse engineer, decompile, or disassemble the app
  • Attempt to circumvent the daily session limit
  • Use the app in any way that violates applicable laws
  • Share premium features with non-premium users
  • Attempt to interfere with or disrupt the Service

6. Intellectual Property

All content in DiepeRust, including text, graphics, logos, audio, and software, is owned by DiepeRust or its licensors and is protected by copyright and trademark laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

7. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

We don't guarantee that:

  • The Service will always be available or uninterrupted
  • The Service will be error-free or secure
  • The results from using the Service will meet your expectations
  • The breathing exercises will solve your specific health issues

8. Limitation of Liability

To the maximum extent permitted by law, DiepeRust and its creators, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service.

Our total liability for any claims related to the Service is limited to the amount you paid us in the last 12 months (or $100, whichever is greater).

9. Health and Safety Notice

Please consult a healthcare professional before starting any breathing or meditation practice if you have:

  • Respiratory conditions (asthma, COPD, etc.)
  • Cardiovascular conditions
  • Mental health conditions requiring medication
  • Any other medical concerns

10. Changes to the Service

We may modify, suspend, or discontinue the Service at any time, with or without notice. We won't be liable if we make changes to the Service or stop providing it entirely.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll notify you through the app or by email (if we have it). Your continued use of the Service after changes take effect means you accept the new Terms.

12. Termination

You can stop using DiepeRust at any time by deleting the app. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ends immediately.

13. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles. Any disputes will be resolved in the courts of the Netherlands.
